Calvin Barry, Criminal Lawyer Profile

Calvin Barry articled with a well known Bay Street law firm and worked as a Highway Traffic Act Prosecutor with the Provincial Prosecutors Office before moving to the position of Assistant Crown Attorney with the Office of the Crown Attorney in 1988. He has appeared as a Criminal Prosecutor at all levels of Trial Courts and has prosecuted numerous homicides and other high profile indictable matters. In October 2004, after 16 years as a senior crown attorney he left the Attorney General`s office to join McPhadden Samac Merner Barry. His practice is restricted to criminal and regulatory matters.

Mr. Barry now acts as a criminal defence lawyer for all types of criminal charges. In his private practice Mr. Barry has defended high profile fraud cases, drug related matters, assault, theft, manslaughter and murder charges. Mr. Barry has been particularly successful in defending a large number of drinking and driving charges, such as impaired driving, over 80 mg of alcohol in the blood and failure to blow.

Mr. Barry’s community involvement includes having served as chairman of the Attorney General’s United Way campaign, fundraiser for the Children’s Wish Foundation, participant in the Metropolitan Toronto Police Torch Run for charity, and Chairperson of the Sunnybrook Stables Fundraiser for the Canadian Olympic Equestrian Team. He also served as Chairperson of the 50th Anniversary of Prosecutors, Ontario Crown Attorney’s Association (1996) and as a co-organizer of the Annual Jack Hughes Memorial Crown Attorney’s Baseball Tournament (1991-95).

Mr. Barry is currently a member of the Criminal Lawyers Association. He is a past director of the board of the Ontario Crown Attorney’s Association (1990-2000), and , in particular, worked as Treasurer of the Association (1994-95) and as a member of the Association’s Finance Committee (1996-97). He has also served as a member of the Toronto Mayor’s Task Force on Drugs (1995-98); a director of the Board of Directors of Variety Village; and a director of the Osgoode Hall Alumni Association

Exchange Bandit accused remanded

A financial services employee who is alleged to be a bank robber known as "the Exchange Bandit" appeared briefly in court yesterday.

Within hours after the release of high quality images of a bank robber, Kevin John Pinto, 37, and his lawyer walked into downtown 52 Division Friday.

A subdued Pinto was remanded in custody until tomorrow after his lawyer Calvin Barry asked for an adjournment. Pinto is facing 10 charges of robbery.

A source close to Paradigm Capital, the firm where Pinto worked, said his co-workers jokingly asked him when he would be hiring a lawyer after they saw a striking resemblance between him and the bandit when they were all watching TV news.

Pinto was a "well-liked employee" and his co-workers were surprised by the allegations, the source said.

As vice-president of compliance at the Toronto-based investment firm, he was responsible for ensuring that the company followed securities and financial rules.

Police say Pinto is suspected in 26 bank heists across Southern Ontario over the last five years.

A series of robberies took place in 2003 in Toronto and Peel Region and in 2004 in Kitchener, St. Catharines and Niagara Falls.

The robber, who typically began each heist by talking to a teller about exchanging currency, disappeared for two years. Less than a month ago, a robber was caught on surveillance video holding up a Scotiabank on King St. west of Yonge St.

Police released images from that robbery and others on Thursday and were flooded with tips almost immediately.

Police said Pinto has been living in an upscale lakefront condo off Queen's Quay.
